Public Law, Chapter 209 (2019) provides that a “visiting qualifying patient from another jurisdiction that authorizes the medical use of marijuana … who possesses … a valid medical marijuana certification from that other jurisdiction and photographic identification … may engage in conduct authorized for a qualifying patient.”

However, most states will not recognise Maine MMJ Cards. Check the related state page on the Leafwell website before you travel to confirm.

Getting a Medical Marijuana Card in Portland, Augusta, Bangor, Scarborough and Westbrook, Maine

Throughout Maine, cannabis is legal for medical and recreational use. A few locations have unique laws, however, such as Scarborough who passed new rules on cannabis which took effect February 21 2020. Businesses in Scarborough are now able to cultivate, manufacture and test marijuana for medical and recreational use.

In Portland, a local licensing system, fee schedule and rules were adopted for medical and recreational marijuana businesses in May 2020.

In 2019, Augusta proposed a rule which would allow medical marijuana sales with no recreational sales permitted. Augusta’s approach means we recommend all Maine residents apply for an MMJ card if possible in case local restrictions are imposed in the future, although we do not expect this to happen at a state level.

There are a maximum of 8 state-licensed dispensaries that are allowed to be operational in Maine at any one time.

Tax rates are expected to reach about 20% per gram for recreational users. Medical marijuana users will likely save on some sales taxes which is why holding an MMJ Card is so valuable.
